Barake Terms of Service

1. Agreement

These terms govern your use of the Barake app and of the barake.app website, both published by Orizon42. By creating a parent account, you agree to them, on your own behalf and on behalf of the teens you add to Barake.

2. Who may use Barake

A parent account must be created by an adult who has reached the age of majority where they live. That adult takes responsibility for the way their family uses Barake.

A teen takes part only through a contract sent by their parent. They do not create an account. By adding a teen, the parent confirms that they are that teen's parent or legal guardian, and consents to the processing of the teen's data as described in the Privacy Policy.

3. What a Barake contract is — and what it is not

Barake lets a parent write a contract with their teen: up to three chores and the days they happen, a duration with an end date, rewards unlocked at completion levels, and a consequence if the contract is not kept. The parent signs and sends it; the teen reads it, accepts it or suggests something else; then the teen checks off their chores and the parent approves them.

A Barake contract is a family agreement. It has no legal force. It is not a contract within the meaning of civil or commercial law, not an employment agreement, and not a promise enforceable by anyone — including by Orizon42. The names typed at signing are a way of saying "I agree" inside the family. They are not electronic signatures within the legal meaning of that term.

Barake does not settle disagreements between the members of a family and takes no part in them.

4. Barake handles no money

Rewards, and any amounts attached to them, are written down by the parent. They are promises made within the family, nothing more.

• Barake does not receive, hold, transfer or pay out any money, and does not act as an intermediary for payments of any kind.
• Rewards are handed over outside the app, by the parent, when and how they choose. "Mark as paid" is only a note in the app.
• Neither Barake nor Orizon42 guarantees that a reward will be given, or that a consequence will or will not be applied.

The only payment connected to Barake is the Premium subscription, which is processed by Apple or Google (see section 8).

5. Rewards and consequences

The parent alone chooses the rewards and the consequence written into a contract, and is responsible for them. A consequence must stay proportionate and respectful: it must never be violent, degrading, dangerous, or contrary to the law or to the teen's interests. The teen reads the consequence before signing and may suggest something else.

6. Your account and your teen's access

You are responsible for keeping your sign-in details confidential and for activity carried out from your account. Tell us promptly if you suspect unauthorized access.

Your teen's access is tied to the phone on which they signed. If that phone is lost or the app is reinstalled, you can reopen their access from your own app.

Anyone holding a contract link can read that contract while it is waiting for your teen's signature (see the Privacy Policy). Share the link with your teen only.

7. Your content

You keep ownership of what you write in Barake — chore titles, rewards, consequences, notes. You grant Orizon42 only the right to host that content and display it to the members of your family and to whoever holds the contract link, solely to operate the service.

You agree not to write anything unlawful, violent, hateful, or harmful to a person's dignity, and not to use Barake to pressure, humiliate or monitor anyone. We may remove clearly unlawful content and suspend the account involved.

8. Free plan and Premium subscription

The free plan covers one active contract at a time, for one teen. Premium adds unlimited active contracts, all your teens, custom reminders and contract history, and automatic contract renewal.

• Prices are shown in the app and in the App Store or Google Play before you confirm a purchase, in your local currency.
• Payments are processed by Apple or Google, depending on your device. We never receive or store your payment details.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Cancellation happens in your Apple or Google account settings, not in Barake — we have no control over those subscriptions.
• Refund requests are governed by Apple's or Google's policies.
• If pricing changes, you will be notified before renewal.

When a subscription ends, Premium features stop at the end of the period already paid for. Your contracts and your teens' data are not deleted.

9. Reminders and notifications

Barake sends reminders and notifications through Apple's and Google's notification services. We do our best to deliver them at the time set, but we cannot guarantee that they arrive, or arrive on time: that also depends on the phone, its settings and its network.

10. Availability

We work to keep the service available but do not guarantee uninterrupted access. Interruptions may occur for maintenance, updates, or because of a technical provider.

11. Disclaimers and liability

Barake is a family organization tool. We are not responsible for arrangements made within your family, for whether commitments between its members are honored, for the rewards promised or given, or for the consequences applied.

To the extent permitted by law, the service is provided "as is." Our liability will not exceed the amounts you paid for the subscription in the previous twelve months. Nothing here limits liability for gross negligence, fraud, or personal injury where the law forbids such limitation, nor the rights you have as a consumer under mandatory law.

12. Termination

You may delete your account at any time under Profile. Deletion is permanent: it ends your contracts and erases your family's data as described in the Privacy Policy. You may also remove a teen from your family once none of their contracts is still running.

Deleting your account does not cancel a subscription: cancel it first in your Apple or Google account settings.

We may suspend or terminate an account for a serious breach of these terms, after notifying you where possible.

13. Intellectual property

The app, the website, the Barake brand, its interface and its code remain the property of Orizon42. Nothing here transfers any right in them to you.

14. App Store

If you downloaded Barake from Apple's App Store, these terms are between you and Orizon42, not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for addressing claims relating to it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims of intellectual property infringement. If the app fails to conform to an applicable warranty, you may notify Apple, which may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes

We may update these terms. For material changes, you will be notified in the app before they take effect. Continuing to use the service afterward constitutes acceptance.

16. Governing law and disputes

These terms are governed by French law. This choice does not deprive you of the protection afforded by the mandatory provisions of the law of the country where you habitually reside.

We will first try to resolve any dispute amicably: write to us using the details below. If no agreement is reached, the dispute may be brought before the competent courts, including, if you are a consumer, the courts of your place of residence.
